URP: IV.11.d Distribution of Printed Material

STATEMENT OF PURPOSE

The freedoms of speech, expression, and assembly are fundamental rights of all persons and are central to the mission of the University. Students, faculty members, and staff members are free to express their views, individually or in organized groups, orally or in writing or by other symbols, on any topic, in all parts of the campus, subject only to rules necessary to preserve the equal rights of others and the other functions of the University.

The distribution of printed information, including the hanging of signs and banners, on TWU property must comply with Federal, State, and Local laws, and with University policies, regulations, and procedures.

DEFINITIONS

Center for Student Development (CSD): The Center for Student Development promotes student engagement at TWU and through its various leadership and service opportunities.

The CSD is located on the Denton campus; however, the Office of Student Life on the Dallas and Houston campuses each provide their local campus community with CSD services and support. In this URP, CSD refers to the respective CSD location on each TWU campus.

Harassment: aggressive, persistent pressure or intimidation

Libel: defamation expressed in written or other graphic form that tends to blacken the memory of the dead or that tends to injure a living person’s reputation and thereby expose the person to public hatred, contempt or ridicule, or financial injury or to impeach any person’s honesty, integrity, virtue, or reputation or to publish the natural defects of anyone and thereby expose the person to public hatred, ridicule, or financial injury. Literature: any printed material, including any newspaper, magazine, or other publication, and any leaflet, flyer or other informal matter, that is produced in multiple copies for distribution to potential readers.

Obscene: material or a performance that:

  1. the average person, applying contemporary community standards, would find that taken as a whole appeals to the prurient interest in sex;
  2. depicts or describes:
    1. patently offensive representations or descriptions of ultimate sexual acts, normal or perverted, actual or simulated, including sexual intercourse, sodomy, and sexual bestiality; or
    2. patently offensive representations or descriptions of masturbation, excretory functions, sadism, masochism, lewd exhibition of the genitals, the male or female genitals in a  state of sexual stimulation or arousal, covered male genitals in a discernibly turgid state or a devise designed and marketed as useful primarily for the stimulation of the human genital organs; and

PROCEDURES

DISTRIBUTION OF PRINTED MATERIAL

The University has provided adequate facilities for distribution of interoffice mail, official campus publications, and similar materials. The use of the aforementioned facilities is restricted to those persons comprising the University community. Material distributed through such facilities must be related to University-sponsored business or must be otherwise specifically authorized to be distributed through such facilities after approval has been obtained from the Center for Student Development (CSD).

All persons and organizations, both those officially and those not officially connected with the University, may come upon University property for effecting the distribution of announcements, notices, pictures, advertisements, or publications only after giving notice to the CSD of the time, place, and manner of such distribution and by filing a copy of the material to be distributed with the CSD at least one day prior to the time of distribution.
